At Peacock & Co we understand that Trusts can seem a complicated prospect for some clients, but we endeavour to explain the procedure and logistics clearly at the outset to ensure that our clients understand the process.

Estate Administration (Commonly known as Probate)
Dealing with a person’s Estate when they die can be a complex, onerous and often time consuming task. A wide ranging spectrum of financial products may require scrutiny and tax issues may need to be addressed; it can therefore be easy to overlook important elements of the process. We understand that this can be an unwanted burden at a difficult time, and we always aim to assist in a prompt and compassionate way, whilst providing a full explanation of the process and the likely duration and timescales for obtaining any Grant of Probate.
We can also help deal with the responsibilities of reporting to HM Revenue & Customs, and to making final distributions to the beneficiaries.
If a Will cannot be traced, we can advise and assist with the intestacy process and the necessary applications and paperwork. In addition, we can advise as to the potential beneficiaries who may be entitled to benefit from an Estate in these circumstances. As required by the Solicitors Regulation Authority we will always provide a comprehensive estimate of the likely costs, and will keep you fully updated. Our fees are calculated on an hourly basis, with no value uplift.
It is often the case that most banks and building societies will charge a percentage, which can be as much as 4.0% to 4.5% of the Estate value. Therefore, the basis upon which we charge for our fees means that our costs usually prove to be more economical than such institutions.
It may be the case that the deceased’s Will does not provide for any tax planning benefits, or perhaps a beneficiary would rather pass their entitlement to another family member. In such circumstances we can advise and, if necessary, prepare a Deed of Variation to the deceased’s Will to take into account inheritance tax benefits, and, ultimately the family’s wishes.
Lasting Powers of Attorney
A Lasting Power of Attorney is a legal document that a person can make utilising a prescribed form. It allows an individual to choose someone they trust to make decisions on their behalf at a time in the future when either they lack mental capacity or no longer wish to make those decisions themselves.
